Some contracts with foreign legal entities require mandatory registration with authorized state institutions, otherwise they may be deemed null and void.
The record (registration) of foreign economic agreements (contracts) is carried out by the Ministry of Economy of Ukraine, as well as empowered by it Ministry of Economy of Autonomous Republic of Crimea and corresponding structural divisions at the regional, Kiev and Sevastopol city state administrations.
Within the Ministry of Economy of Ukraine the functions of the record (registration) of the foreign economic agreements (contracts) are put on the department for state control and regulation of external economic activities.
The record (registration) of the foreign economic agreements (contracts) on export of waste and scrap of ferrous metals (code of Goods Nomenclature for Foreign Economic Activities of Ukraine - 72 04) is carried out exclusively by the Ministry of Economy of Ukraine with the approval of the Ministry of Industrial Policy of Ukraine regardless registration cost of contracts.
Foreign economic agreements (contracts) regarding operations with customer-owned raw materials of Ukrainian customer, are subject to record (registration) only in the case if the contract provides, that finished goods will be realised in the country of executor or exported to other country.
Procedure of the record (registration) of the foreign economic agreements (contracts).
Defined set of documents are required for the record (registration) of the foreign economic agreements (contracts).
If the subject of foreign trade activities of Ukraine who has applied for registration, charges the implementation of foreign economic agreement (contract) to another subject of foreign trade activities of Ukraine, the originals of the following documents must be added also: procuratory, commission, agency, consignment, dealer, distributor, rent, leasing and storage contracts as well as contracts on hiring and on general activity and cooperation, and their copies certified in established order.
Confirmation of the registration of foreign economic agreement (contract) is the registration – record card of the contract, issued in established form.
Consideration of contracts, their record (registration), preparation and issuance of registration – record cards of the contract are carried out by the department for state control and regulation of external economic activities of the Ministry of Economy of Ukraine within the period of not more then ten working days from the date of representation of documents.
If any reasons for refusal in registration are revealed during consideration of the contract the letter is sent to contract applicant with substantiation of motives of refusal. The applicant has the right to improve documents according to the requirements of this Order. In this case the term of consideration of documents is discontinued for the period up to representing modifed documents by the applicant.
The subject of foreign trade activities of Ukraine, who submitted on registration, will get back all originals of foreign economic agreements (contract) and the contracts specified above after the consideration.
Cards of registration-record of foreign economic agreement (contract) and the contract original stand out to the applicant at a presentation it of the document which proves the identity and the commission on their reception.
