Customs accreditation in Ukraine, registration of subjects of foreign economic activity with Kyiv Regional Customs, Kiev Oblast (Region) Customs or Central Energy Customs

General overview. Ukrainian customs regulation is rather strict and bureaucratic. Currently the customs formalities may be completed by a legal entity only if it is accredited with the respective customs office depending of its place of state registration. At that, only Ukrainian entities or the representative offices of foreign companies may obtain such accreditation. That is why in practice the custom formalities are completed either by Ukrainian resident company to the contract or by representative office of the foreign company in Ukraine.

Finally, if the customs clearance of the goods or vehicles shall be made at different place than the place of state registration, the investor is to obtain an authorization letter from the customs office, where it is registered.


Customs accreditation, registration of subjects of foreign economic activity with Kyiv Regional Customs. All subjects of foreign economic activity regardless of ownership form (including individual entrepreneurs) as well as representative offices of foreign legal entities, which are located in the area of Kyiv city and willing to import or export of goods or vehicles, are required to register with the Kyiv regional customs. Branches and subsidiaries of the Ukrainian subjects of foreign economic activity, without creation of legal entity, are not subject to registration.

All export and import operations of subjects of foreign economic activity are conducted on the basis of the Customs accreditation card (Record card), signed by head of the legal entity and a personal seal of the customs official. All fields of the Record card must be filled in. Registration cards completed with corrections and errors can not be accepted for accreditation at the Kyiv regional customs. The accreditation is carried out by a special customs department.

Should the complete set of documents be submitted, the registration can be finalized by a customs officer within one working day. During accreditation a customs officer examines all submitted documents, compares them to originals and makes respective marks over the copies of the required documents. Such verification is carried out only once during initial accreditation.

In case of absence of remarks in relation to accreditation of this subject of foreign economic activity a customs officer assigns to the Registration card a registration number and fills in it on three copies of the Registration card. The legal entity is responsible for accuracy of the documents and information declared in the Record card.

In case a subject of foreign economic activity leases its office, the Registration card validity shall be limited to the lease period. Should the lease be prolonged, the card shall be automatically extended.

Two Registration cards together with the copies of documents remain in the group of Registration and the third copy of Registration card is returned to the subject of foreign economic activity.

In case of changes about the subject (change of telephone number, legal or postal address, etc), which were declared in the Registration card (except for the change of the name of enterprise), in a week term alterations are made to the Registration card by submitting a new card in three copies and supporting documents as well as copies, which prove respective changes. After changes the registration number of the Registration card remains intact.

Cancellation of the Registration card is carried out in cases of loss of the Registration card, liquidation of enterprise or change of its name, halt of foreign economic activity, exposure of counterfeit documents of the subject, unreliable information, double account in the area of activity of the Kyiv regional customs, accreditation with another custom body, etc.

The rescinded Registration card remains in archive of the Kyiv regional customs together with the complete set of documents, on the basis of which the registration of the subject of foreign economic activity was carried out. Registration number of the rescinded Customs accreditation card is not used in future.

List of documents, required for accreditation at the Kyiv regional customs:

1. Registration card (in three copies);

2. Constituent documents (originals and notarized copies);

3. Minutes (decision, order) about appointing the director of an enterprise (original and a copy);

4. Certificate of state registration of subject of entrepreneurial activity (original and notarized copy);

5. Certificate from statistics bodies (original and a notarized copy);

6. Certificate from servicing bank about the opened accounts (original);

7. Order of enterprise about appointing the chief accountant of an enterprise (copy);

8. Order of enterprise about appointing the declarant, who will be responsible for work with customs (original);

9. Originals and copies of passports of all persons indicated in the Registration card;

10. Value-added tax payer certificate (copy) or a guarantee letter that an enterprise is not a payer of VAT (original);

11. Lease contract, if absent own office (copy);

12. A letter about presence or absence of foreign investment (original);

13. In case the citizen of the foreign state is the director of an enterprise, an Order appointing a person - citizen of Ukraine which temporally will perform duties of the director in the period of his absence and an order on complete material responsibility for activity of enterprise. In the case of necessity presentation of a work permit and visa of a foreign citizen;

14. If the documents are submitted by a custom broker - confirmation of powers.

Customs accreditation, registration of subjects of foreign economic activity with Central Energy Customs. To be accredited with Central Energy Customs, the subject of foreign economic activity is to be registered first with either Kyiv Regional Customs or Kiev Oblast Customs depending on its location. In order to get registration the subject is to approve the authorization letter on double accreditation with Kyiv Regional Customs or Kiev Region Customs depending on its location, which shall be the fundamental document for accreditation with Central Energy Customs.

The subject of foreign economic activity is to submit the same package of documents as described above. Some peculiarities are as follows:

1. Registration card is submitted in four copies;

2. Authorization letter on double accreditation approved by the Kyiv Regional Customs or Kiev Oblast (Region) Customs depending on previous accreditation of the legal entity.

3. The documents are to be submitted to the customs together with originals. The copies of documents are to be certified by the seal of enterprise.
